Rumberger Elects Two New Partners in Florida
ORLANDO and TAMPA, Fla. – Rumberger, Kirk & Caldwell is pleased to announce associates Darren McCartney in Orlando and Jared Smith in Tampa have been elected to partner.

Since joining the firm in 2004, McCartney handles a wide variety of commercial litigation from the Uniform Commercial Code to construction defect claims, with particular emphasis on consumer litigation claims related to allegations of violations of the FTC Act and Florida’s Deceptive and Unfair Trade Practices Act (FDUTPA). He was an integral part of defending against certification of a Florida statewide class-arbitration claim based on alleged violations of the FDUTPA. McCartney also assists clients in the defense of individual and class-action claims based upon alleged violations of the FTC Act, FDUTPA, and other state unfair trade practice acts in Florida as well as other states across the country. He has defended FDUTPA claims arising out of consumer service agreements, real estate agreements, and commercial transactions on behalf of large national companies.
While earning a juris doctor from the University of Florida Levin School of Law, McCartney was the Articles Editor for the Florida Law Review. He graduated magna cum laude and was number two in his class. Prior to law school, he served six years in the United States Marine Corps.
Smith has significant experience in casualty defense, mass tort defense, specifically asbestos litigation, and construction defect litigation. He also litigates a variety of commercial matters involving the banking industry.
Smith is an active member of the Construction Law Committee of The Florida Bar’s Real Property, Probate and Trust Law section as well as the Hillsborough County Bar Association Construction Law Section. His litigation experience includes multimillion-dollar construction defect and Chinese drywall claims. Smith is also a member of the American Bar Association Construction Forum, Division 7, and the Tort Trial and Insurance Section. In addition, Smith is a member of the Tampa Bay Builder’s Association.
Before joining Rumberger, Smith had the honor of serving four years in the U.S. Air Force as part of the Judge Advocate General's Corps (JAG). He was certified as a U.S. Air Force Military Trial and Defense Counsel. In addition to prosecuting military crimes, he was appointed as a Special Assistant United States Attorney to prosecute civilian crimes in federal court. While assigned to MacDill Air Force Base, Smith advised the Chief of Operations for MacDill AirFest, provided counsel to the Chief of Staff of the MacDill hospital, and oversaw the handling of tort claims against the base.
Smith earned a bachelor’s degree in Accounting, summa cum laude, from Fort Hays State University. He earned a juris doctor from Washburn University School of Law, graduating 3rd in his class.
Smith was named a Florida Super Lawyers Rising Star in 2010. He also serves as a Deacon with Idlewild Baptist Church in Tampa.
